REAL v. NAR - MOVE inc et al.

This Federal Patent Infringement suit resulted from MOVE inc filing a declaratory judgement motion in CA. against REAL seeking to have the patent holder assert that Realtor.com and the other sites operated by MOVE did NOT infringe the patents.

This tactic came on the heels of the summary judgement motions in the Sarkisian case being filed. As anticipated, all of the defense claims of invalidity and unenforcibility made by the NAR lead defense were denied by the court. That ruling might have led to a swift trial and ultimate defeat for the defense.

MOVE's tactic allowed the PA judge to tie and defer that case to the outcome of this newer CA case. Essentially this allowed the delay tactics utilized in the first case to be repeated, while tapping into a new expansive source of legal funding, not directly attributable to the NAR.
