This is the first legal action filed by the patent holder. Moore Data (MLS) & HomeAdvisor (MS) mounted an aggressive defense and the case was eventually discontinued without determination, in part, due to the limited financial resources of the patent holder. Both defendants shortly thereafter abruptly exitted the market.

With additional Legal and financial resources the patent holder sought to stem the tide of the rampant growth in the utilization of the patented mapping method. This sample case, against a top producing real estate agent, would establish precedent to collect damages from over a million other infringers. This case has now been deferred and tied to the outcome of the 2008 California Case currently before the federal district court.

The details of this case serve as another disappointing and embarrasing indictment of MOVE Inc and even the NAR.
